Richard Walinski recently published Choice of Law in Ohio: The Entire Restatement 2d of Conflicts, 22 Ohio Lawyer 17 (November/December 2008).
He discusses Ohio's "adoption" of the Restatement 2d for choices of law in civil cases. He discusses two critical steps in the Restatement 2d that attorneys -- and, therefore, courts -- routinely ignore. He makes two points about the missed steps. First, they can change the outcome of a case because they can change what law the court would otherwise apply to the dispute. Second, the two missed steps can significantly reduce the frequency of forum-shopping, the much criticized practice in which lawyers shop to identify a state whose law they believe most favors their clients' claims and then file the case there.
